  1. Introduction

These Terms & Conditions (“Terms”) govern your use of The Weight Care Clinic LTD’s website, services, medical consultations, subscription plans, and access to treatment (“Services”).

By using our Services, you agree to these Terms. If you do not agree, please discontinue use immediately.

The Weight Care Clinic LTD (“we”, “us”, “our”) is a CQC-registered, doctor-led medical weight-management clinic providing online medical and GP consultations, treatment plans and ongoing clinical supervision (CQC registration number: 1-25046369175).

  1. facilitating communications (including advice and consultations, where applicable) between you and the following prescribers and non-prescribers:
  • prescribing Doctors engaged by The Weight Care Clinic who are registered with the General medical Council in the United Kingdom (UK), hold accredited prescriber qualifications, and who may facilitate medical consultations and prescribe medications where clinically appropriate (Prescribers).
  • medical (including doctors and nurses), allied health care practitioners and support staff (including pharmacists, dieticians, nutritionists, personal trainers, health coaches and patient engagement and customer support specialists) acting on our behalf (Contributors); and
  • third party health service providers and practitioners which have an arrangement with us (whether directly or indirectly) but do not act on our behalf (Associate Practitioners); and
  1. providing or facilitating the following services and products:
  • providing access to the Platforms which contain:
    • certain records of your communications with Prescribers and Contributors and other medical information; and
    • support information and services including recipes, exercises, community support, individual support, tracking functions, analytical insights and information about various aspects of the Condition

Acceptance of this document

  1. Each time you access, use, or purchase from the Platforms (including the use of any of the Services), you acknowledge and warrant that you have read, understood and agree to be bound by this document (Terms). The Terms form a legally binding agreement between us and you. If you do not agree to the Terms, you must immediately exit and not access or use the Platforms or the Services.
  2. You are responsible for complying with the Terms.
  3. From time to time, we may review and update the Terms. Any variation to the Terms will take effect from the date notified on the Platform(s), and your continued use of the Services following that date will be bound by those varied terms (subject to cl 2(d)-(e)).
  4. The Terms which apply at the time you request or receive a Service are those that govern your access to that Service. Any changes to the Terms do not affect rights and obligations that arose prior to the changes.
  5. Please review these Terms periodically for changes. Where required to do so, we will provide you reasonable notice of changes.
  1. Eligibility
  1. The Services provided through the Platforms are only available to individuals who:
  • are over 18 years old;
    reside in the UK.
  • access the Services within the UK.
  • Be resident in the UK
  • Complete all required medical questionnaires honestly
  • Have a consultation with a registered healthcare professional
  • Not be pregnant or breastfeeding
  • are capable of entering a legally binding agreement with us
  • where relevant, have capacity to consent to medical treatment (as determined by a Prescriber in accordance with the Mental Capacity Act 2005).
  • agree to these Terms and our Privacy Notice; and
    where the Services involve a subscription
  1. You will provide us with personal information about you, including your name, age, date of birth, gender, contact details and sensitive information, such as health information. We will handle your personal information in accordance with our Privacy Notice.
  2. You must be physically located in the UK at the time of consultation and treatment. We may request confirmation of your location.
  3. You agree that all information you provide via the Platforms (including to Prescribers, Pharmacy, Contributors, Associate Practitioners and Associate Couriers) will be true, accurate, up-to-date and complete and that you will not omit any information that is requested of you, or that a reasonable person would consider relevant to the Services you seek.
  4. If you wish to have another person (a “Proxy”) wholly or partly manage your application for Services and/or the provision of Services provided to you on your behalf, you must provide evidence that the Proxy has the legal authority to make healthcare decisions for you. This may include, but is not limited to, a certified copy of a Power of Attorney for health matters, a court order appointing a guardian, or any other legally recognised documentation. We reserve the right to request additional evidence as necessary to verify such documentation.
  5. We reserve the right to not provide, or to withdraw the provision of, any Services to you in circumstances including where, at any time:
  • Prescriber or Associate Practitioner determines that you are clinically ineligible or unsuitable for the Services.
  • you have breached these Terms.
  • you indicate that you do not wish to use the Services.
  • you have appointed a Proxy and appropriate legal authority for your Proxy is not satisfactorily demonstrated; or
  • your behaviour on the Platforms, or towards a Prescriber, Contributor, Associate Practitioner or one of our employees or contractors, is abusive or otherwise unacceptable as reasonably determined by our Clinical Director
  1. Medical Services We Provide

We offer:

  • Doctor-led weight-management consultations
  • Prescription-only weight-loss medication where clinically appropriate
  • GP consultations
  • Ongoing clinical supervision
  • Access to your secure patient record through our Electronic Medical records (EMR)
  • Diet and exercise programmes
  • Subscription plans for continued care and medication supply
  • Specialist support for side-effect management

We do not provide emergency care. If you require urgent medical help, call 999 or 111.

Services provided by Partner Prescribers and Partner Contributors

Consultations with Prescribers

  1. When you undertake a consultation with a Prescriber, you enter a clinical treatment relationship with that Prescriber. We are not liable for services (including the provision of medical advice and the prescribing of medicines) provided as part of that relationship.
  2. Prescribers operate within the protocols and processes set by The Weight Care Clinic, however they also have clinical independence and are responsible for the healthcare services they provide to you, including compliance with standards of care and guidance issued by their professional regulator, record keeping and other professional obligations, as well as compliance with applicable law (including privacy laws). They have the same obligations to you as if they were consulting you in person.
  3. You acknowledge that the Services do not include general medical advice from the Prescribers and instead only contemplate an assessment of your suitability for The Weight Care Clinic services, as well as medical advice and the issuing of prescriptions in connection with the Condition. Accordingly, you acknowledge that a Prescriber with whom you enter a treatment relationship does not replace the role of your general medical practitioner
  4. We do not guarantee that you will be able to consult with a particular Prescriber or engage with a particular Contributor. You acknowledge that a Prescriber may, in exercising their clinical judgement, refuse to prescribe medication to you, issue you a repeat prescription and/or provide any other services or referrals requested by you at their absolute discretion.
  5. We do not guarantee that a consultation with a Prescriber is suitable for you or is the appropriate course of treatment for your health condition. The Prescriber with whom you consult will be solely responsible for determining:
  • whether or not a consultation through the Platforms is clinically appropriate for you.
  • whether or not to provide the medical and/or health services you request; and
  • what health services are required (if any).

Additional Services, Investigations & Treatment Costs

• The Weight Care Clinic provides private GP and specialist consultation services in addition to medical weight management

• Fees for these services are separate from any weight management plans or subscriptions and will be confirmed at the time of booking

• Blood tests are available from £59; costs may vary depending on the specific investigations required

• Following consultation, additional investigations, prescriptions, or treatments may be recommended where clinically indicated

• Medication and treatment costs are not routinely included within consultation fees, packages, or subscriptions and may be subject to additional charges

• Patients will be informed of any additional costs prior to proceeding with further treatment or investigations

• All services are delivered by GMC-registered doctors in accordance with clinical guidelines and professional standards

• Treatment plans, including medication type and dosage, are determined based on clinical assessment and may be adjusted in line with patient response and safety considerations

Prescriptions issued by Prescribers

  1. A Prescriber may issue a prescription for a particular medicine and with a particular number of repeats if they consider it to be clinically appropriate. You acknowledge and agree that:
  • the decision to issue a prescription (including for “off label use”) is a clinical decision made at the discretion of the Prescriber and by accepting the treatment you are providing your informed consent; and
  • the number of repeats to include with a prescription is similarly subject to the clinical discretion of the Prescriber who may take into account all relevant circumstances, including their capacity to supervise your treatment with the prescribed medicine where relevant.
  1. If a Prescriber prescribes you a medicine for “off label use”, you acknowledge that the prescribed use of that medicine is not listed as one of the indications for use by the Medicines and Healthcare products Regulatory Agency (MHRA).
  2. You agree that the fact that a Prescriber prescribes you a particular medicine does not constitute a representation that that medicine is available for dispensing (whether from the Pharmacy or otherwise). We take no responsibility and make no warranties, express or implied, about the available supply, or ongoing availability of supply, of any medicine prescribed by a Prescriber in advance of the dispensing of that medicine by the Pharmacy.
  3. All Prescribers act with full clinical independence in accordance with regulatory standards and are solely responsible for their medical decisions, prescriptions and advice. The Weight Care Clinic LTD is not liable for clinical decisions or outcomes arising from Prescriber actions.
  4. Where clinically appropriate, and in line with GMC guidance, we may share relevant information with your GP. We will obtain your consent unless an exemption applies (e.g., serious risk of harm).

Services provided by Partner Prescribers and Partner Contributors

Consultations with Partner Prescribers

When you undertake a consultation with a Partner Prescriber, you enter into a clinical treatment relationship with that Partner Prescriber. We are not liable for services (including the provision of medical advice and the prescribing of medicines) provided as part of that relationship.

Partner Prescribers operate within the protocols and processes set by the Pharmacy, however they also have clinical independence and are responsible for the healthcare services they provide to you, including compliance with standards of care and guidance issued by their professional regulator, record keeping and other professional obligations, as well as compliance with applicable law (including privacy laws). They have the same obligations to you as if they were consulting you in person.

You acknowledge that the Services do not include general medical advice from the Partner Prescribers and instead only contemplate an assessment of your suitability for The Weight Care Clinic Programme, as well as medical advice and the issuing of prescriptions in connection with the Condition. Accordingly, you acknowledge that a Partner Prescriber with whom you enter a treatment relationship does not replace the role of a general medical practitioner outside the Platforms.

We do not guarantee that you will be able to consult with a particular Partner Prescriber or engage with a particular Partner Contributor. You acknowledge that a Partner Prescriber may, in exercising their clinical judgement, refuse to prescribe medication to you, issue you a repeat prescription and/or provide any other services or referrals requested by you at their absolute discretion.

We do not guarantee that a consultation with a Partner Prescriber is suitable for you or is the appropriate course of treatment for your particular health condition. The Partner Prescriber with whom you consult will be solely responsible for determining:

  1. whether or not a consultation through the Platforms is clinically appropriate for you;
  2. whether or not to provide the medical and/or health services you request; and

iii. what health services are required (if any).

We take no responsibility and make no warranties, express or implied, in relation to the content of any consultation between you and a Partner Prescriber (including any medical advice provided, prescriptions given and/or medicine supplied by a Partner Prescriber). You and the Partner Prescriber are responsible for the conduct of each consultation and all information or communications made.

Prescriptions issued by Partner Prescribers

A Partner Prescriber may issue a prescription for a particular medicine and with a particular number of repeats if they consider it to be clinically appropriate. You acknowledge and agree that:

  1. the decision to issue a prescription (including for “off label use”) is a clinical decision made at the discretion of the Partner Prescriber and by accepting the treatment you are providing your informed consent; and
  2. the number of repeats to include with a prescription is similarly subject to the clinical discretion of the Partner Prescriber who may take into account all relevant circumstances, including their capacity to supervise your treatment with the prescribed medicine where relevant.

Services provided by Partner Contributors

Certain Partner Contributors may provide medical advice (doctors, nurses, pharmacists), dietary advice (dieticians, nutritionists) and general health and exercise advice (health coaches, personal trainers) within their scope of practice. The Partner Contributors have clinical independence and are responsible for the healthcare services they provide to you, including compliance with standards of care and guidance issued by their professional regulator, record keeping and other professional obligations, as well as compliance with applicable law (including privacy laws). They have the same obligations to you as if they were consulting you in person. You acknowledge that this advice is only provided in connection with the Condition.

You and the relevant Partner Contributor are responsible for all information or communications made in connection with any medical advice.

Facebook Community

Patients that have been prescribed prescription-only medicines by Partner Prescribers may be invited to join our Facebook Community to connect with certain Partner Contributors as well as other WCC patients

Services provided by Contributors

  1. Certain Contributors may provide medical advice (doctors, nurses, pharmacists), dietary advice (dieticians, nutritionists) and general health and exercise advice (health coaches, personal trainers) within their scope of practice. The Contributors have clinical independence and are responsible for the healthcare services they provide to you, including compliance with standards of care and guidance issued by their professional regulator, record keeping and other professional obligations, as well as compliance with applicable law (including privacy laws). They have the same obligations to you as if they were consulting you in person. You acknowledge that this advice is only provided in connection with the Condition.‍

General provisions

  1. You acknowledge that Prescribers and Contributors may request confirmation or clarification of information you have previously provided and may request additional information from you in connection with the Services. You agree to provide accurate, complete and up-to-date information to Prescribers and Contributors (and to correct any previously provided information which is or becomes inaccurate). You further acknowledge that the provision of incorrect information in connection with obtaining prescription medicines may constitute a criminal offence.
  2. Prescribers, Contributors and Associate Practitioners will keep records of each consultation or other communication with you and it is their responsibility (where applicable) to maintain your clinical and other records as required by law and in accordance with the Privacy Notice. We may hold those records and will maintain them as required by law and in accordance with the Privacy Notice.
  3. To the fullest extent permitted by law, our total liability to you for any claim arising from the Services is limited to the total fees paid by you in the preceding 12 months. We are not liable for delays from third-party couriers, pharmacy stock issues, adverse reactions resulting from failure to follow medical advice, or outcomes based on incomplete/incorrect information provided by you.
  4. If a Prescriber prescribes you a medicine, you must carefully read all information provided to you via the Platforms about that medicine, the information contained on any packaging or leaflets provided with the medication as well as any information provided in connection with the Pharmacy, if applicable. You must also follow any medical advice provided to you by a Prescriber, Contributor or Associate Practitioner in relation to any prescribed medicine.
  5. You should seek medical advice immediately if your medical condition changes or your symptoms worsen, either by contacting your general medical practitioner, dialling 111, or if you think you are in an emergency or need urgent assistance, calling 999 or seeking urgent medical help at your nearest hospital emergency department. You agree that, if you suffer from any noticeable side effects from any medication or treatment you receive, you will either consult your general medical practitioner or contact us to facilitate a further consultation with a Prescriber or Contributor.
  6. If our clinicians believe you are at risk of serious harm, we may contact emergency services, safeguarding authorities or your GP as required by law.
  1. Consultations & Patient Responsibilities

All consultations are conducted online via our Electronic Medical Record (EMR) platform.

You agree to:

  • Provide accurate and complete medical information
  • Update us about new symptoms or medication changes
  • Notify us immediately of any side effects
  • Follow the treatment plan provided
  • Keep all appointments or reschedule with notice
  • Only use the medication for yourself

You agree not to withhold relevant medical information and to use all prescribed medication solely for your personal use. Any misuse, non-disclosure or suspected diversion of medication may result in immediate termination of treatment without refund and may be reported to appropriate authorities.

Cancellations or rescheduling require a minimum of 48 hours’ notice. If you cancel with less than 48 hours’ notice or fail to attend your appointment, the full consultation fee will be charged.

Pre-Consultation Health Measurements

Prior to any clinical consultation, you must obtain accurate and up-to-date measurements of:

  • Weight
  • Height
  • Blood pressure
  • Heart rate

These measurements must be taken within a clinically reasonable timeframe before your consultation. You may obtain these free of charge at most UK pharmacies or via your GP practice.

You confirm that the measurements you provide are accurate. If you consent, we may contact your GP to verify or obtain relevant clinical information where required for your safety and in line with GMC and CQC guidance.

  1. Prescriptions & Medication

We prescribe medication only if clinically appropriate.

All medication is dispensed by an online pharmacy.

The Weight Care Clinic operates independently from the Pharmacy, including separate premises staff, management, and records.

The Pharmacy is responsible for dispensing medications, delivering and related pharmaceutical services, while The Weight Care Clinic provides weight management, medical assessment, and related consultations.

Each entity is responsible for the recruitment, employment, and supervision of its own staff, and shall ensure compliance with applicable professional standards and licensing requirements.

Each entity shall maintain separate patient records related to its own services. Any sharing of patient information shall be in accordance with applicable data protection laws and with the patient’s consent where required.

All charges for The Weight Care Clinic services and Pharmacy products/services shall be invoiced and paid to the respective entity responsible for the services billed.

Each entity shall comply with applicable healthcare regulations, professional standards, and licensing requirements, and maintain appropriate professional indemnity or liability insurance for its own operations.

Important notes:

  • Medication costs vary by pharmacy and may change.
  • We do not guarantee availability of any specific drug.
  • You must read all medication information provided before use.
  • You must report side effects immediately.

If your clinician deems treatment unsafe, we may suspend or cancel your prescription.

  1. Certain Contributors may provide medical advice (doctors, nurses, pharmacists), dietary advice (dieticians, nutritionists) and general health and exercise advice (health coaches, personal trainers) within their scope of practice. The Contributors have clinical independence and are responsible for the healthcare services they provide to you, including compliance with standards of care and guidance issued by their professional regulator, record keeping and other professional obligations, as well as compliance with applicable law (including privacy laws). They have the same obligations to you as if they were consulting you in person. You acknowledge that this advice is only provided in connection with the Condition.‍
  2. You acknowledge that Prescribers and Contributors may request confirmation or clarification of information you have previously provided and may request additional information from you in connection with the Services. You agree to provide accurate, complete and up-to-date information to Prescribers and Contributors (and to correct any previously provided information which is or becomes inaccurate). You further acknowledge that the provision of incorrect information in connection with obtaining prescription medicines may constitute a criminal offence.
  3. Prescribers, Contributors and Associate Practitioners will keep records of each consultation or other communication with you and it is their responsibility (where applicable) to maintain your clinical and other records as required by law and in accordance with the Privacy Notice. We may hold those records and will maintain them as required by law and in accordance with the Privacy Notice.
  4. If a Prescriber prescribes you a medicine, you must carefully read all information provided to you via the Platforms about that medicine, the information contained on any packaging or leaflets provided with the medication as well as any information provided in connection with the Pharmacy, if applicable. You must also follow any medical advice provided to you by a Prescriber, Contributor or Associate Practitioner in relation to any prescribed medicine.
  5. The Weight Care Clinic LTD and the dispensing pharmacy operate as separate legal entities. The Clinic is responsible only for medical assessment. The Pharmacy is solely responsible for dispensing, supply, delivery and quality of medication.

  1. Pricing, Payment & Subscriptions

6.1 Consultation Fees

  • Initial consultation: £49.99 (credited against your first treatment). Please note, this price may be lower during special offers.
  • Follow-up consultations: As priced on the website

Fees are payable at the time of booking.

6.2 Subscription Plans

We offer subscription plans which include (dependant on level of subscription):

  • Medication supply
  • Ongoing clinical support
  • Biweekly/Monthly check-ins
  • Priority response
  • Blood test
  • Side-effect guidance

Minimum Term

All subscription plans have a minimum 6-month commitment.

You may not cancel during this period except in specific medical circumstances (see Section 10).

After 6 months, subscriptions continue monthly until cancelled with 7 days’ notice

Direct Debit Payments

Where you choose to pay by Direct Debit, you authorise us to collect payments automatically in accordance with your subscription plan.

You are responsible for ensuring sufficient funds are available. Failed payments may result in suspension of services or medication supply until payment is resolved.

You may cancel a Direct Debit at any time through your bank; however, this does not cancel your contractual obligations under these Terms, including minimum subscription periods.

6.3 Non-Subscription (Pay-As-You-Go) Patients

If a patient declines a subscription plan:

  • We offer one-off consultations
  • We may offer discretionary discounts
  • Medication-only transactions may incur an admin fee
  • Subscription plans will always be priced more attractively

Payment for the Services

Subscription payments

With the exception of certain products and services which may be purchased on a one-off basis, most Services offered via the Platforms may only be purchased on an automatically renewing subscription basis. This means that at each subscription interval (usually monthly), we will conclude a new contract with you pursuant to which you agree to pay the subscription fee and we agree to provide the Services (as applicable to you). The terms of that contract will be communicated to you during the order confirmation process.

If and for so long as a subscription contract is agreed between you and us, you agree for the payment mechanism you have provided us to be billed at regular intervals. We will give you notice of this in advance of each renewal date and provide you the opportunity to pause or cancel your subscription before your contract is renewed.

When you conclude a subscription contract with us, the fact that the subscription fee is a particular price (or that any other term provides for particular rights or obligations) does not constitute a representation that renewed contracts with us will contain that subscription fee (or any other term). Accordingly, we may, in our sole discretion, vary the fees and payment terms applying to the Services at any time.

Any change to the fees or payment terms applying to the Services will be immediately effective upon the publication of that change on the Platforms or by otherwise providing notice to you and will apply to the Services requested by you in the subsequent subscription interval following that change. You will be provided an opportunity to decide not to renew the subscription contract in these circumstances.

If you have booked or paid for Services prior to a change in fees or payment terms being published on the Platform(s) or otherwise notified to you, but have not received the Services prior to that change taking effect, you will not be charged more for the applicable Services at the time you receive them.

All prices listed on the Platforms for the Services are inclusive of VAT and shipping costs where relevant

6.4 Klarna Programme Terms

  1. Patients selecting Klarna enter into a fixed-term 6 or 12 month clinical programme agreement.
  2. The full programme fee is payable at the time of enrolment via Klarna.
  3. The Clinic receives payment upfront; the patient’s repayment agreement is with Klarna.
  4. Pricing reflects anticipated dose escalation across treatment.
  5. If deemed clinically unsuitable following assessment, a full refund will be issued.
  6. After treatment commences, refunds are not available for change of mind.
  7. Early withdrawal does not remove financial liability.
  8. Prescribing remains subject to clinical judgement at all times.

Medication costs are included within the structured programme price based on anticipated clinical need. Significant deviation from expected dosing may require pricing review.

  1. Cancellation & Refund Policy
  1. You have rights under UK consumer laws in relation to the provision of the services and products provided to you by us, including rights to refunds in certain circumstances as set out in this section.
  2. By booking a consultation or subscribing to a treatment plan, you request that we begin providing medical services immediately. Under Regulation 36(1)(a) of the Consumer Contracts Regulations 2013, the statutory 14-day cooling-off period does not apply once a clinical assessment, consultation or prescription review has commenced.
  3. You may cancel a specific order, or your subscription to The Weight Care Clinic, at any time and for any reason by submitting a request to info@theweightcareclinic.com. We may also cancel a specific order or your subscription at any time, at our absolute discretion with reasonable notice, or otherwise in accordance with these Terms including clause 3(e).
  1. Once a clinician has reviewed your medical information, conducted a consultation, or issued a prescription, the service is deemed fully delivered and no refunds are available
  2. After 6 months, you may cancel with 7 days’ notice before your next billing date.
  3. In relation to Consultations: cancellations or rescheduling require a minimum of 48 hours’ notice. If you cancel with less than 48 hours’ notice or fail to attend your appointment, the full consultation fee will be charged.
  1. If you cancel your subscription, your subscription will remain active until the end of your then-current subscription period, and you will continue to receive the products and services that you have already paid for, unless otherwise agreed at the time of cancellation.
  2. In circumstances where you cancel a specific order or subscription, we may offer a refund on that order or subscription period, only if:

    i. you submit a request to cancel your order prior to commencement of the next subscription period, and such cancellation is only processed by us after your payment has been collected for that next subscription period;
  1. for a non-prescription product, you submit a request for a refund within 14 days of delivery. You then have 14 days to return the unused product in its original condition, at your own expense.

iii. you have a right to a refund under a valid special offer that may be in force from time-to-time; or

  1. at any other time where a product, service or pricing error is identified, or a product is faulty, damaged or wrong.
  1. In circumstances where we cancel a specific order or subscription for one of the below reasons, we will offer a refund on that order or subscription period:
  1. you are deemed unsuitable for treatment; or
  2. we are unable to dispense a specific order due to lack of stock.
  3. If you are eligible for a refund, it will be made using the payment method you used for the original transaction. We cannot process refunds to alternative cards or payment methods.

Consultations:

  • Cancellations require 48 hours’ notice.
  • Less than 48 hours or if client does not attend online appointment = no refund.

Medication:

Prescription medication cannot be returned, refunded or reused for safety and regulatory reasons (MHRA/GPhC). No refunds can be issued once medication has been dispensed.

Refunds are only issued where legally required (e.g., service not delivered).

  1. Deliveries

Medication delivery is handled by third-party partner pharmacies.

The Weight Care Clinic LTD is not responsible for:

  • Courier delays
  • Lost parcels
  • Incorrect delivery information provided by the patient

We will support you in resolving any issues directly with the pharmacy.

Patient Feedback

We may contact you by email, SMS or other electronic means to request feedback about our services for quality improvement, patient safety and regulatory purposes. This feedback is optional and will not affect your care.

  1. Suspension or Refusal of Treatment

We may suspend or decline treatment if:

  • It is medically unsafe
  • You fail to provide requested medical information
  • You misuse medication
  • You breach these Terms
  • You behave abusively towards staff
  • You fail to pay fees due

  1. Indemnity and liability
  1. You agree to indemnify and hold harmless us and our related entities, our directors, officers, partners, employees, agents, contractors, affiliates, service providers, suppliers and licensors in respect of any liability, loss or damages (including reasonable legal fees) suffered or incurred by them arising (in whole or part) out of your breach of or failure to comply with any of these Terms (or the documents they incorporate by reference), your use of the Platforms or your violation of any law or the rights of a third party.
  2. We are not responsible for, and accept no liability with respect to, any material uploaded, posted, transmitted or otherwise made available on the Platforms by any person other than us. We do not endorse any opinion, advice or statement made by any person other than us.
  3. To the extent permitted by law, including UK consumer law, in no event shall we be liable for any indirect loss or damage which may be suffered due to your use of our Platforms and/or the information or materials contained on them, or as a result of the inaccessibility of our Platforms and/or the fact that certain information or materials contained on them are incomplete, incorrect or out of date.
  4. We disclaim liability resulting from the provision of services (including advice) by Prescribers. All Prescribers are responsible for the clinical services they perform.
  5. If we fail to comply with these Terms, we will only be liable to you for the purchase price of the product(s) and/or any losses that you suffer as a result of the failure to comply with these Terms, which are foreseeable consequences of such failure. We are not responsible for any loss or damage that is not foreseeable at the time we enter into the relevant contract with you, any events outside of our control, or any business losses. Nothing in these Terms will otherwise restrict your statutory rights, including for any liability that cannot be limited or excluded by law in the UK.

We make no guarantee that the products and services provided through the Platforms are fit for your intended purpose.

  1. Nothing in these Terms is intended to exclude, restrict or modify any condition, guarantee, warranty, right or remedy that you may have under the Consumer Rights Act 2015 or any other applicable legislation which may not be excluded, restricted or modified by agreement.
  2. Nothing in these Terms is intended to confer a benefit to any third party under the Contracts (Rights of Third Parties) Act 1999, and a person who is not a party to these Terms has no right to enforce them.
  3. Each of the clauses in these Terms operates separately. If a court or relevant authority finds that any clause is unlawful, invalid or unenforceable, this will not affect the validity of the remaining Terms which will remain in full force and effect.
  4. If we fail to insist that you perform any of your obligations under these Terms, or if we delay or do not enforce our rights against you, this does not mean that we have waived our rights against you and does not mean that you do not have to perform your obligations.
  5. We may transfer our contract with you so that a different organisation, including any related entity, is responsible for the provision of the Services. If this happens, we will ensure that we notify you of the transfer. You cannot transfer these Terms to anybody else.
  1. Jurisdiction
  1. These Terms are governed by English law. The Platforms may be accessed throughout the UK and overseas. We make no representation that the content of the Platforms complies with the laws of any country outside of the UK. If you choose to access the Platforms from outside the UK, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. You should not use our Services if you do not reside in the UK.
  2. Wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
  1. Private health insurance claims
  1. Consultations provided by a Prescriber are not eligible for any rebates by the National Health Service (NHS).
  2. If you are eligible to claim private health insurance benefits for any Services, we provide you are responsible for submitting the paid invoice to your insurer to claim any eligible benefits.
  3. You are solely responsible for maintaining the accuracy of your details, including your private health insurance details and any bank account or credit card details to which you would like to receive payments. We disclaim any and all liability for claims or payments which cannot be processed due to incorrect information provided by you.

16.Discounts

  1. We may provide discounts (including through the use of promotional codes) for particular Services and for particular patients, in particular circumstances.
  2. Discounts and promotional codes for Services which include prescription medicines are only available to patients of prescribers who have determined, in their clinical discretion, that they are suitable for the medicine. The offer of a discount or promotional code to you for such services does not constitute any representation that a prescriber will determine you to be suitable for any medicine.
  3. Any discount or promotional code offered by us, unless otherwise specified:
  • is only valid for a limited time, purpose and application (as stated in the offer).
  • may only be redeemed once per customer.
  • may only be applied at the time of purchase, not retrospectively.
  • is not transferrable and may not be resold.
  • may only be used by customers who reside in, and access the Services from within, the UK; and
  • cannot be used in conjunction with any other offer(s).
  1. Violation of any of these Terms will invalidate the promotion and render the discount or promotional code inapplicable.
  1. Pre-Consultation Health Measurements

Prior to any clinical consultation, you must obtain accurate and up-to-date measurements of:

  • Weight
  • Height
  • Blood pressure
  • Heart rate

These measurements must be taken within a clinically reasonable timeframe before your consultation. You may obtain these free of charge at most UK pharmacies or via your GP practice.

You confirm that the measurements you provide are accurate. If you consent, we may contact your GP to verify or obtain relevant clinical information where required for your safety and in line with GMC and CQC guidance.

  1. Subscription Agreement

Minimum 6-Month Commitment Contract

By joining a subscription plan, you agree that:

  • Minimum term: 6 months
  • Payment is monthly by card or direct debit
  • No refunds or cancellations during the minimum period
  • After 6 months, cancel anytime with 7 days’ notice
  • Medication supply is dependent on clinical safety
  • Your subscription may pause if medically inappropriate
  • Prices may change with 30 days’ notice

Your subscription includes (dependant on level of subscription):

  • Monthly check-ins
  • Medication oversight

By proceeding with treatment:

You confirm that:

  • You are 18+
  • You have provided complete and truthful medical information
  • You understand GLP-1 medications and other medications may carry risks
  • Side effects may occur and must be reported immediately
  • Weight loss is not guaranteed
  • Medication may be stopped if clinically unsafe
  • Remote consultations have limitations
  • You agree to follow the clinical plan
  • You will read all safety information supplied

The Weight Care Clinic is not a suitable service for emergency circumstances. If you are in an emergency situation or need urgent assistance, including obstructed breathing, heart pains, blood loss or swelling, please call 999 or seek urgent medical help at your nearest hospital emergency department. If you think you may need to visit your nearest hospital emergency department but it’s not life or limb threatening, the NHS also recommends that you can dial 111. The 111 service can also help if you’re in mental health distress, or your GP practice, pharmacy, or dental practice is not available.‍
